Employment Discrimination
The United States Constitution says that every person has the right to life, liberty and the pursuit of happiness. Part of this right is the right to find and hold employment. Laws have been passed in California making it illegal for an employer to discriminate against an employee due to her/his race, religion, national origin, sex, or sexual orientation. It is further illegal for an employer to harass an employee or allow others to harass the employee due to these protected categories. It is further illegal for an employer to retaliate against an employee in the terms and conditions of employment , including by terminating or demoting the employee, because, she/he complains about such discrimination and/or harassment.
You must file a complaint with the EEOC and/or DFEH within the prescribed time periods to protect these rights prior to filing a lawsuit.
